Overview
Drive Locations Pty Ltd (ABN 12 661 673 025) is the owner of the Drive Locations © app.
The Drive Locations app was originally designed to provide subscribers with places of interest to visit within Australia.

After 12 months it was determined that the App had potential to provide more than content to subscribers and the Board decided to embark on a new strategy to “Connect People through Fun Experiences”.

The key elements of the new strategy are:
Development of the app to capture events and other key data of interest to our subscribers.
Partnerships with corporations, community and government to maximise the benefits to our subscribers.
Capture of place of interest, events and fun activities for each subscriber.
Ensuring participation is affordable to all.

Working with and for the benefit of local communities providing services to our subscribers.
In order for Drive Locations to implement the key elements of our strategy we need to collect certain information from our subscribers. When collecting this information Drive Locations commit to:

Consult – with our subscribers about what, how and why we collect the data.
Accept – the decisions made by our subscribers, when deciding what they share.
Respond – in a timely manner to the update of the information provided.
Engage – in a respectful manner with our subscribers and partners to ensure adherence to this policy and expect our subscribers and partners to adhere to these core principles.

Acceptance of Terms
Welcome to Drive Locations (“we,” “us,” “our,” or the “App”). Drive Locations is an Australian travel application operated out of New South Wales, Australia. These Terms and Conditions (“Terms”) govern your access to and use of the App, the website located at https://www.drivelocations.com (if applicable), and any related services (collectively, the “Services”).

By accessing, browsing, or using our Services, you (“User,” “you,” or “your”) agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to all of these Terms, you must immediately discontinue using our Services.

Binding Agreement
By downloading, accessing, or using the Services, you confirm that you have read these Terms and agree to be bound by them. If you do not agree, do not use our Services.

Eligibility
You must be at least 18 years of age to use the Services or have explicit permission from a parent or guardian. By using the Services, you represent and warrant that you meet all legal requirements to form a binding contract in your jurisdiction.

Drive Locations reserves the right to cancel any subscription where they are in breach of any laws, regulations , these terms and conditions and/ or other policy documents released by Drive Locations at any time.

Changes to Terms
We reserve the right to update or revise these Terms at any time by posting the updated Terms in the App or on our website. Your continued use of the Services after any such change constitutes your acceptance of the revised Terms.

Scope of Services
Drive Locations provides curated travel and location discovery services throughout Australia, offering information on roads, travel sites, unique destinations, events and information of interest to our subscribers.

License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purposes.

Geographic Restrictions
Although our primary focus is Australia, the Services may be accessed internationally. We make no representations that the Services are lawful or appropriate outside of Australia. If you access the Services from outside Australia, you do so at your own risk.

User Accounts
Registration
To access certain features, you may be required to create an account and provide certain information about yourself. You agree to provide accurate, current, and complete information and to update it if it changes.

Account Security
You are responsible for safeguarding your account credentials. We are not liable for any unauthorized access to or use of your account. You must immediately notify us of any suspected or actual unauthorized use of your account.

Account Termination
We reserve the right to suspend or terminate your account at any time, without notice, if we believe you have breached these Terms or engaged in any unlawful or improper use of the Services.

User Conduct
Prohibited Activities
You agree not to:
Violate any applicable laws, regulations, or third-party rights.
Use the Services for any illegal or unauthorized purpose.
Interfere with or disrupt the operation of the Services or servers/networks connected to the Services.
Attempt to hack, reverse-engineer, or otherwise compromise any aspect of the Services.
Use the Services for spamming, unsolicited communications, or any form of harassment.

User-Generated Content
If the App allows you to submit reviews, photos, or other content, you represent and warrant that:
• You own or have the necessary rights, licenses, and permissions to share such content.
• Your content does not infringe any third-party rights or violate any law.
We reserve the right to remove or modify any user-generated content at our sole discretion.

Intellectual Property
Ownership
All trademarks, logos, designs, text, graphics, images, software, and other content (collectively “IP”) used within or in connection with the Services are owned by or licensed to Drive Locations. You have no rights to our IP except as expressly provided in these Terms.

License Restrictions
You shall not modify, distribute, reproduce, publish, license, create derivative works from, or sell any part of our IP without our prior written consent.
Opt-In for Marketing Communications

Consent
By creating an account or otherwise providing your personal information, you consent to receive marketing communications, including but not limited to newsletters, promotions, and updates about travel destinations, from Drive Locations and its affiliates. You may opt out at any time by following the unsubscribe instructions in the communication or by contacting us directly.

Third-Party Communications
We may occasionally share your email or other contact information with select partners or third-party service providers for marketing or other business purposes, in accordance with our Privacy Policy and applicable law.

Disclaimer of Warranties
No Guarantees
The Services are provided on an “as is” and “as available” basis. While we endeavour to maintain accurate and up-to-date information, we do not warrant the completeness, reliability, or accuracy of any content available through the Services.

Travel and Safety
We are not responsible for any incidents, accidents, or losses arising from your travel based on information provided by the App. Travel involves inherent risks, and you are responsible for reviewing any alerts, advisories, or information from relevant authorities before traveling.

Limitation
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.

Limitation of Liability
Indirect Damages
To the maximum extent permitted by applicable law, in no event shall Drive Locations, its directors, employees, or affiliates be liable for any indirect, consequential, special, or incidental damages (including, but not limited to, damages for loss of data, loss of profits, or business interruption).

Cap on Liability
If, notwithstanding the other provisions of these Terms, Drive Locations is found to be liable to you, our liability shall not exceed the fees you paid to us (if any) in the previous six (6) months or AUD $100, whichever is greater, subject to applicable laws.

Indemnification
You agree to defend, indemnify, and hold harmless Drive Locations, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including legal fees) arising from:
1. Your use or misuse of the Services.
2. Your breach of these Terms.
3. Your violation of any third-party right, including intellectual property or privacy rights.

Third-Party Links and Services
Our Services may contain links to third-party websites, applications, or resources that are not owned or controlled by us. We do not endorse nor assume any responsibility for such third-party sites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of or reliance on any such third-party content.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of New South Wales and the Commonwealth of Australia, without regard to conflict of law principles.

Dispute Resolution
Any dispute arising out of or related to these Terms shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be submitted to the exclusive jurisdiction of the courts of New South Wales, Australia.

Termination
We may terminate or suspend your access to the Services at any time, with or without cause or notice, including if we believe you have breached these Terms. All provisions of these Terms that by their nature should survive termination shall survive (including, without limitation, intellectual property, warranties, disclaimers, and limitations of liability).
